RE[FRAMED] GENERAL TERMS AND CONDITIONS FOR EVENTS
These General Terms and Conditions (the «T&Cs») govern the relationship between you (the «Customer» or «Ticket Holder») and RE[FRAMED] (the «Organizer») regarding the purchase of tickets and attendance at the events organized by Re[Framed].
1. Definitions and Acceptance
The events described herein are organized by Marta Alegre Vicente, trading as RE[FRAMED]. The Organizer’s Tax ID is 72313511Q, with registered address at Diagonal 100 1-5, 08019 BARCELONA. The contact email is marta@reframed.com.
“The Organizer” is the sole promoter and responsible party for the production and execution of the Event.
The “Ticketing Platform” is the third-party entity authorized by the Organizer for the processing of sales, payment, and ticket distribution.
The purchase of a Ticket and access to the Event constitutes the full and unreserved acceptance of these RE[FFRAMED] General Terms and Conditions for Events and the Terms and Conditions of the Ticketing Platform. The contract for the Event (the show/service) is established directly between the Customer and the Organizer.
2. Ticket Purchase, Price, and Validity
The Organizer only guarantees the authenticity of Tickets purchased through the official Ticketing Platform.
The final Ticket price includes the face value of the Ticket and Value Added Tax (VAT). The price does not include the separate service or management fees applied by the Ticketing Platform.
The contract is formalized upon acceptance of the purchase order by the Customer. Once the order is accepted, the Ticket is considered purchased, and its characteristics and conditions cannot be modified.
The Organizer is not responsible for the services provided by the Ticketing Platform for the management and processing of Ticket payments, as this payment is executed through an external payment gateway not owned by the Organizer. Consequently, the Organizer accepts no responsibility for any charges, fees, or technical failures that occur within the payment platform, nor for delays in the refund processes managed by the payment gateway or the Customer’s bank.
The resale of Tickets or any onerous legal act of transferring the use or ownership of the Tickets to third parties is strictly prohibited. In such cases, the Organizer may cancel the Tickets without reimbursement and prevent the third party holders from accessing the venue, without prejudice to the right to claim for damages. The Organizer does not assume any liability for the loss or theft of the Ticket.
The Ticket Holder is responsible for the safekeeping of its Tickets and assumes all liability in the event that the Tickets are duplicated or forged.
3. Event Changes, Cancellation, and Refunds
The Organization reserves the right to alter or modify the program (e.g., timings, opening acts, artist lineup changes) without prior notice, and this does not entitle the Customer to a refund.
If the Event is definitively cancelled, the purchaser may request a refund within fourteen (14) calendar days from the date of the public announcement of the cancellation, as specified by the Organizer.
The Organizer will only refund the cost of the Ticket (face value). The Organizer is not responsible for any other expenses incurred by the Customer (e.g., hotels, travel, meals) as a result of the cancellation or change.
Total or partial cancellation due to unforeseen circumstances or force majeure not attributable to the Promoter will not give rise to a refund of the amount paid, except in cases where this is legally established.
No refund will be issued in case of cancellation, suspension, or modification that occurs once the show has started and is due to unforeseen circumstances or force majeure. The inability to attend the show or a mistake made when purchasing the Tickets are not reasons to allow their return or refund.
4. Event Access, Security, and Regulations
The Customer is solely responsible for ensuring that their mobile device is charged, functional, and that the digital Ticket is readily accessible upon entry to the Venue. Failure to gain access due to technical issues related to the Customer’s device (e.g., low battery, damaged screen, signal loss at the Venue) will not constitute a valid reason for a refund or guaranteed admission. All Tickets must be verifiable by the Organizer’s scanning system.
Access to and stay in the venues will only be possible upon accreditation of the Tickets purchased, which will be scanned for verification by the Organizer. Ticket holders must keep their tickets for the duration of their stay and must identify themselves with ID, if requested.
The Organizer reserves the right of admission in accordance with Decree 112/2010 of 31 August (Catalan regulations on public shows) and other applicable regulations. For security reasons, people and their belongings (bags, backpacks) may be subjected to a search.
It is strictly prohibited to enter with: drinks or drink containers, animals, professional photographic/video/sound recording equipment (e.g., reflex cameras, video cameras, tripods), objects that may be considered dangerous, or narcotic substances.
The Organizer will prevent access or stay to:
a) People who display violent or aggressive attitudes, or who publicly incite hatred or discrimination; persons carrying weapons or objects likely to be used as weapons.
b) People who show signs of drunkenness or who are consuming or show signs of consuming drugs or psychotropic substances. Persons accessing and remaining in the venues must scrupulously follow all the safety rules and instructions provided by the Organizer’s staff. Non-compliance may be grounds for expulsion without compensation. If the holder leaves the concert, they lose the right to come back, unless specified otherwise by the Organizer for a particular event.
5. Minors Policy
Access for minors to the Event requires the corresponding Tickets to be shown at the venue access control. Access for minors up to 15 years of age (included) requires the purchase of a specific Ticket (if applicable) and they must be accompanied by a parent or legal guardian who must present ID and family book or equivalent legal document.
Minors aged 16 and over may enter the site unaccompanied with a general admission ticket, unless otherwise specified for the specific venue. The person responsible for the minor must sign a document exonerating the Promoter from liability, which will be provided at the entrance. The accompanying person will be responsible for any action of the minor. The sale of alcohol and tobacco to persons under the age of 18 is strictly prohibited.
6. Intellectual Property and Data Protection
Unauthorized filming, recording, or reproduction within the precincts for any use outside the strictly private sphere (especially commercial or promotional purposes) is prohibited.
The acquisition and/or possession of the Tickets does not entitle the holder to use the Tickets or their contents for advertising, marketing, or promotional purposes (including competitions, gifts, and/or draws).
The Ticket Holder acknowledges that upon entering the venue, they may be filmed and photographed by the organization, and these graphic supports may be used for the sole purpose of promoting the organization’s activities.
All intellectual property rights, including but not limited to copyrights, trademarks, logos, photographs, video footage, graphic designs, and sound recordings created, used, or displayed by RE[FRAMED] (or its authorized contractors) in connection with the Event or the Venue shall remain the sole and exclusive property of the Organizer. The Ticket Holder is granted only a limited, revocable license to attend the Event and holds no rights to the Event’s or Organizer’s intellectual property.
Re[Framed] will process the personal data of the Customer in accordance with its own Privacy Policy. The Customer can consult the full Privacy Policy on the Organizer’s website.
7. Limitation of Liability
The Promoter shall not be liable for any damages, losses, costs and/or expenses suffered by the User as a result of non-compliance or defective compliance with the rules, indications or safety instructions provided. The Organizer will not be responsible for the loss or theft of personal belongings of the persons attending the venues. Attendees shall be exclusively liable for any damage or harm caused by them during their access to and stay at the venues.
8. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Organizer RE[FRAMED] and its representatives from and against any and all claims, liabilities, damages, losses, and expenses (including, without limitation, reasonable legal fees and costs) arising out of or in any way connected with:
a) The Customer’s breach of any of these General Terms and Conditions (T&Cs), including the prohibition of ticket resale (Section 2).
b) Any negligent act or omission, or willful misconduct by the Customer during the Event or their stay at the Venue. c) Any claims brought against the Organizer by a third-party Ticket Holder who acquired the Ticket from the Customer outside of official channels.
9. Severability
If any part of these General Terms and Conditions (T&Cs) shall be deemed unlawful, void, or for any reason unenforceable by a competent authority, such provision shall be considered severable from the T&Cs and shall not affect the validity and enforceability of the remaining provisions. The ineffective provision shall be considered as not in force, and the validity and effectiveness of the rest of the T&Cs shall remain intact.
10. Claims, Governing Law and Jurisdiction
The Ticket Holder acknowledges that all official communications regarding the Event, including any last-minute changes, postponements, or refund procedures, will be published through the Organizer’s designated official channels, which include: the Organizer’s website, the email address provided during the Ticket purchase, and/or the Organizer’s official social media accounts. The Organizer fulfills its duty of notification once the information has been posted or sent via these channels. It is the Customer’s responsibility to regularly check these channels prior to the Event.
Complaint forms are available on site at the conclusion of the show and at the Organizer’s head office.
The Organizer informs that, according to Art. 40 of Law 7/2017, access to the online dispute resolution platform is available at:
https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=ES
These T&Cs shall be governed by the laws of Spain. Any conflict arising will be submitted to the Courts and Tribunals of Barcelona.
